That is what a bicyclist is alleging in his lawsuit following a crash in between Aspen and Basalt on Highway 82 this past summer.
The man who filed the lawsuit is an "experienced" cyclist, which makes his accident all the more dramatic. He had been riding west on the highway when the front tire of his bicycle was caught, throwing him onto the pavement near mile marker 26, sources report. The cyclist is alleging that he rode his bicycle into an area that was under construction by the Colorado Department of Transportation, a general contractor and a subcontractor. The problem was, however, that there were no warnings or signs that indicated the area was being repaired.
Following the crash, the man was rushed to the hospital where it was determined that he broke his hand. In total, he is asking for over $100,000 for the crash, accusing the Department at its contractors of failing to adequately mark a construction site.
There is no doubt that proper signage and warnings are vital for keeping a construction site safe, both for motorists and for construction workers. Without the proper warnings, there may not be any indication that a stretch of road requires extra precaution. Unfortunately for this man, the lack of signs seems to have caused his serious bicycle accident.
